Former federal prosecutor and defense lawyer James K. Filan predicts that the so-called Hinman Speech documents will be made public by June 6, according to a court order. The Hinman documents relate to a 2018 speech by former Securities and Exchange Commission (SEC) corporation finance division director Bill Hinman, who opined that Ether (ETH) was not a security. The documents pertain to the SEC’s internal discussion and deliberations surrounding Hinman’s speech. Some lawyers believe the timeline could be impacted if the SEC appeals or the case leads to a settlement. Meanwhile, Ripple CEO Brad Garlinghouse has expressed eagerness to see the unredacted Hinman emails publicly available soon. Ripple views the documents as an important piece of evidence in its defense against the SEC’s assertion that XRP falls under the classification of a security. The SEC filed a motion to seal the documents from the public in December 2022, arguing that they were irrelevant to the final outcome of the case. However, the motion was officially denied on May 16.
